Richard's
practice is in line with chambers' profile. He specialises
in commercial and civil litigation and has particular experience
in the fields of general commercial law, commercial fraud,
banking law, financial services regulation and insolvency.
He regularly appears as an advocate in the High Court and
County Court. Richard is frequently instructed to act for
banks, in addition to a range of other clients.
General Commercial
- GB
Gas Holdings Ltd v Accenture (UK) Ltd (Commercial Court)
(2009). Acting for GB Gas Holdings in a claim for over £100m
against Accenture for the defective design and implementation
of a customer billing system. Part of a three counsel team
with Jeffery Onions QC and Sonia Tolaney, instructed by
Linklaters.
- Advised
(with Andrew Onslow QC) on freezing injunctions in support
of overseas proceedings for in excess of US$80m.
- Acted
for an English company in proceedings to recover unpaid
invoices from Norwegian and Dutch companies.
- Acted
for an electricity supplier, overturning an injunction to
supply electricity to a phoenix company.
Commercial
Fraud

National Grid Electricity Transmission plc v McKenzie
[2009] EWHC
1817 (Ch). Acting for National Grid in a seven week
Chancery Division trial of a fraud claim involving bribery,
breach of fiduciary duty, dishonest assistance and unlawful
means conspiracy. Part of a three counsel team with Stephen
Phillips QC and Laura John, instructed by Dorsey & Whitney
(2007- 2009).
- Assisted
in various commercial fraud claims in the High Court and
the Court of Appeal. Several of these actions involved significant
international aspects.
Banking
- Regularly
instructed by banks to appear and advise in relation to
a range of disputes, including:
- guarantee
claims;
- breach
of mandate claims;
- disputes
relating to credit reference agency entries;
- Consumer
Credit Act issues;
- applications
for charging orders;

mortgage possession actions;
- debt
claims; and
- unauthorised
overdraft charges claims;
- Experience
of a range of claims relating to cheques and letters of
credit, including fraudulently altered cheques.
Financial
Services

In 2008, Richard was seconded to the Financial Services
Authority in the Markets and Wholesale Firms department
of the General Counsel Division. He gained experience of
a wide range of regulatory issues, and specifically worked
on banking reform, including the Banking Act 2009.
- Advised
(with Andrew Onslow QC) on a potential mis-selling claim
against a bank relating to interest rate swap derivatives.
- Advised
on a potential professional negligence claim against a financial
services compliance advisory firm relating to advice on
collective investment schemes.
- Richard
also has experience of pensions regulation, and has been
instructed by the Pensions Regulator.
Insolvency
-
Regularly
instructed in corporate and personal insolvency applications,
including bankruptcy petitions, annulment applications and
claims contesting the admission of proofs of debt.
- Advised
an English bank on competing claims made on a fund by foreign
liquidators.
- Assisted
with an action in the High Court and the Court of Appeal
relating to the enforcement and recognition of foreign insolvency
proceedings in England.
- Assisted
in proceedings where a company resisted an application for
an administration order on the basis of a disputed debt.
