Practice

David has experience of all of chambers' main practice areas, with particular emphasis to date on financial services, banking, professional negligence and commercial fraud.

Financial Services

  • Advises on all aspects of the regulation of insurance, banking and investment.

  • Instructed in claims relating to unauthorised collective investments scheme, negligent investment advice, SCARPs (precipice bonds), endowment mis-selling and appointed representatives.

  • Financial Services Authority: Seconded in 2005 to the General Counsel Division of the FSA. Subsequently involved in drafting Handbook text implementing the Capital Requirements Directive and as part of the COB Simplification project. Instructed by the FSA in a number of Part VII transfer hearings.

  • Qatar Financial Centre Regulatory Authority: Retained as a consultant advising on the drafting of bespoke Conduct of Business and Collective Investment Scheme legislation. Recently advised in connection with the proposed merger of the QFCRA with other Qatari regulators.

  • Broderick & Another v Centaur Tipping Service Ltd, ChD (Master Teverson) 27.7.06 (Lawtel)
Banking
  • Regularly instructed in relation to disputes between banks and customers and in actions for the enforcement of securities and the protection of mortgagees' security interests.

  • Currently acting for sureties in two separate claims by banks to enforce personal guarantees.

  • Acted for banks and suppliers in a number of hire purchase disputes.
Commercial Fraud
  • Currently instructed on an LCIA arbitration relating to the disappearance of commodities held by a bank as collateral against a credit facility.

  • Jafari-Fini v Skillgass: junior in eight day trial in the Chancery Division concerning bribery and the alleged repudiation of a facility agreement.

  • Currently instructed as sole counsel in a claim against a bank arising out of a £400,000 cheque fraud.

  • Advised multi-national company in a claim to recover costs expended in the investigation of an internal invoice fraud.
Professional Negligence / Construction
  • Currently instructed in a claim against a surveyor for failure to detect structural alterations in a residential house.

  • Acted for a property developer in a claim against an architectural services company for negligent preparation of designs.

  • Acted in a claim against a surveyor for failure to detect asbestos in a residential house.

  • Acted for a residential letting agency in a claim for alleged professional negligence and breach of contract in the selection of tenants.

  • Assisted in the preparation of a highly technical claim against construction professionals in respect of the negligent design and construction of a roof.

  • Advising a school in a claim relating to the negligent installation of a telephone and fire alarm system.

  • Advised on a claim by a Council against an engineering services company relating to a transport infrastructure project.
Insurance and Re-Insurance
  • Instructed as a junior in an arbitration relating to the scope of reinsurance coverage in respect of thoroughbred bloodstock losses arising in Kentucky.

  • Instructed as a junior junior in Commercial Court litigation relating to the placement of professional indemnity policy.

  • Advised a brokerage firm on coverage of professional indemnity policies for construction professionals.

  • Advised a mortgage provider in Jersey on third party rights under a home insurance policy.
General Commercial
  • Assisted in drafting statement of case in LCIA arbitration acting involving alleged breach of distribution agreement regarding supply of oil product to Eastern Europe.
Company / Insolvency
  • Experience of general insolvency work, including winding up and bankruptcy petitions, statutory demands and injunctions to restrain presentation of winding up petitions.

Before coming to the Bar David worked for the Busoga Trust, a charity which installs clean water sources in rural Uganda. He is still involved in raising funds for this work.
