Charlotte specialises in commercial, banking and financial services disputes and is regularly instructed as sole advocate in the High Court and County Courts.
Charlotte is recommended for banking and finance in Chambers and Partners (2012) as a barrister who "picks up sensitive commercial issues when advising financial institutions." Recent reported banking cases include Anfield (UK) Limited v Bank of Scotland plc and ors [2011] 1 WLR 2414; [2011] 1 All ER 708.
Charlotte is regularly instructed on behalf of lenders and other intermediaries in relation to allegations of mis-selling of payment protection insurance (including ICOB/ICOBS breaches) and consumer credit act claims, including alleged unfair mortgage charges. Charlotte regularly appears in the County Courts and High Court on applications, case management conferences and trials relating to the above issues. Cases include Claims Group Direct Ltd v Lloyds TSB Bank plc and ors [2009] LTL 11/11/2009 (claims management companies and champerty) and Holdstock v Endeavour Personal Finance Limited 1 Aug 2011 (unreported) (PPI and unfair relationship).
Charlotte is currently instructed as junior counsel (led by Andrew Sutcliffe QC) in a consumer credit act claim brought on behalf of over 200 claimants in relation to mis-sold timeshare products, to be heard in the London Mercantile Court. She is also instructed on behalf of a lender (led by Paul Lowenstein QC) in a multi-million pound mortgage fraud action brought against both solicitors and valuers in what has been described as one of the largest mortgage frauds in UK history, involving multiple allegations of negligence, breach of contract, breach of fiduciary duty and fraud.
After two secondments at the Financial Services Authority, Charlotte maintains a keen interest in financial services regulation and she is regularly instructed to appear as sole advocate (and as junior counsel: see In the matter of Sompo Japan Insurance inc and Transfercom Limited [2011] EWHC 260 (Ch)) on Part VII insurance business transfers and she undertakes advisory and drafting work in relation to FSMA and the Handbook and related legislation and directives, in particular, Solvency II. Charlotte has also given talks on FSA related topics.
